Fixed-Term Tenancies Are Abolished

From 1 May 2026, all new assured tenancies must be periodic (rolling) from the outset. Fixed-term tenancies, break clauses, and rent review clauses are void in law. Do not use any old agreement with a fixed term.

Key Changes Under the Renters Rights Act

  • No fixed term: All tenancies are periodic from day one — there is no end date
  • No rent review clauses: Rent can only be increased via the Section 13 statutory process (once every 12 months)
  • Pets: The landlord cannot unreasonably refuse a written pet request — refusal must be in writing within 28 days with valid reasons
  • No Section 21: The landlord can only recover possession via Section 8 on prescribed grounds
  • Awaab's Law: Statutory timescales for damp and mould currently apply to social housing landlords only. Private landlords must respond to repair reports promptly and within a reasonable time under Section 11 LTA 1985 and the Homes (Fitness for Human Habitation) Act 2018. Check GOV.UK for the latest position on any PRS extension.
  • Required written tenancy information: For tenancies from 1 May 2026, specified information about the key terms must be provided before the tenancy is signed or otherwise agreed; may be included in the tenancy agreement or provided separately
  • Register Your Rental Property: The landlord must register on the national Register Your Rental Property service when the area enters its rollout period (regional rollout from 15 December 2026; also known as the Private Rented Sector Database)

Landlord Obligations

  • Maintain the structure and exterior of the property in good repair
  • Keep gas, electricity, water, and sanitation installations in working order
  • Provide a valid Gas Safety Certificate (CP12) annually
  • Provide a valid EICR every 5 years
  • Provide a valid EPC (minimum E rating)
  • Provide required written tenancy information before the tenancy is signed or otherwise agreed (for tenancies from 1 May 2026)
  • Respond to repair reports promptly and within a reasonable time under Section 11 LTA 1985 and the Homes (Fitness for Human Habitation) Act 2018
  • Give at least 24 hours' written notice before entering the property
  • Register on Register Your Rental Property when the area enters its rollout period (regional rollout from 15 December 2026)
  • Protect the deposit within 30 days and provide prescribed information

Tenant Obligations

  • Pay rent in full on the due date each month
  • Keep the property clean and in good condition
  • Report repairs promptly in writing
  • Not sublet or take in lodgers without written consent
  • Not make alterations without written consent
  • Allow access with 24 hours' notice for inspections or repairs
  • Not use the property for any illegal purpose
  • Not cause nuisance or annoyance to neighbours
  • Maintain the garden in a reasonable condition (if applicable)

Rent Increases

Rent may only be increased once every 12 months using the statutory Section 13 procedure (Form 4A). The tenant has the right to challenge any proposed increase at the First-tier Tribunal (Property Chamber). Rent review clauses are void under the Renters Rights Act.

Pets

The tenant may make a written request to keep a pet at the property. The landlord must respond in writing within 28 days. Consent cannot be unreasonably refused. Under the Renters' Rights Act, the landlord cannot require the tenant to take out pet damage insurance as a condition of consent. The landlord can require the tenant to repair any damage caused by a pet, and can claim for pet damage from the deposit (within the 5-week cap).

Ending the Tenancy

  • Tenant notice: The tenant must give at least 2 months' written notice, expiring on the last day of a rental period.
  • Landlord possession: The landlord may only recover possession by serving a valid Section 8 notice on one of the prescribed grounds under Schedule 2 of the Housing Act 1988 (as amended). Section 21 no-fault eviction is abolished.

Deposit

The deposit of £[amount] must be protected with a government-approved tenancy deposit scheme within 30 days of receipt. The prescribed information must be provided to the tenant within the same period. The deposit will be returned within 10 days of the tenancy ending, less any agreed deductions.
