Legal Requirement

Under the Gas Safety (Installation and Use) Regulations 1998, landlords must have all gas appliances and flues checked annually by a Gas Safe registered engineer. Failure to comply is a criminal offence and can invalidate a Section 8 notice.

What Is a Gas Safety Record?

A Gas Safety Record (commonly called a CP12) is the certificate issued by a Gas Safe registered engineer after completing the annual gas safety check. It confirms that all gas appliances, pipework, and flues at the property have been inspected and are safe to use.

What the Record Must Include

  • Address of the property inspected
  • Name and address of the landlord (or agent)
  • Description and location of each appliance or flue checked
  • Any defects identified and action taken or required
  • Confirmation that the appliances are safe to use (or unsafe and disconnected)
  • Date of the inspection
  • Name, registration number, and signature of the Gas Safe engineer

Landlord Obligations

  • Annual check: Gas appliances must be checked every 12 months. Do not let the certificate lapse — book the next check before the current one expires.
  • Provide to tenant: Give the tenant a copy of the Gas Safety Record within 28 days of the check being completed, or before they move in if it is a new tenancy.
  • New tenants: Provide a copy of the current Gas Safety Record to new tenants before or on the day the tenancy starts.
  • Keep records: Retain copies of all Gas Safety Records for at least 2 years.
  • Gas Safe registered engineer only: Only engineers on the Gas Safe Register can legally carry out gas safety checks. Always verify the engineer's registration at gassaferegister.co.uk.

Consequences of Non-Compliance

  • Criminal prosecution and unlimited fine or up to 6 months' imprisonment
  • A Section 8 notice served without a valid Gas Safety Record may be invalid — the court can refuse to grant possession
  • Civil liability if a tenant is harmed due to a gas fault
  • Insurance may be invalidated

Tip: Set a calendar reminder 6 weeks before the certificate expires to book the next check. This gives time to rebook if the engineer cancels.
